Statement by India under Agenda Item 5: Interactive Dialogue on the Secretary-General’s Report on cooperation with the United Nations, its representatives and mechanism in the field of human rights at the 57th Session of Human Rights Council (9 September - 11 October 2024) delivered by Mr. Gaurav Kumar Thakur, Counsellor, Permanent Mission of India, Geneva, 27 September 2024

Mr. President

We have noted the report presented by the Assistant Secretary General.

2. Any acts of reprisals and intimidation against those cooperating with the UN and its mechanisms in the field of human rights are unacceptable. India is committed to ensuring a safe working environment for all, including those engaged in promoting and protecting human rights. Due process of law is followed in case of violations, without any exception or discrimination, and adequate judicial and legal remedies are in place.

3. While we note India’s response being reflected in the report, we would have liked detailed facts presented in our recent and past communications to be given due consideration before drawing conclusions.

4. On the issue of Foreign Contributions (Regulations) Act, the references in the report present a biased and incorrect picture without examining the actual text of the law itself. Democratic nations across the world, including India, have had regulations for many decades to guard against legitimate concerns about misuse of opaque or illegal transfer of foreign funds. We reiterate that the principles of transparency and accountability cannot be applied selectively.

I Thank you.
