Mr. Vice President,

  1. 1. We thank the Special Rapporteur for the presentation of his Report and note its conclusions and recommendations.

  2. 2. As also noted in the Report, India has a robust legal and policy framework to protect the dignity of the deceased and prevent and address the issue of extra-judicial, summary or arbitrary executions. The Constitution of India, as well as various laws and the Indian Penal Code, prohibit such offences and provide for accountability mechanisms.

  3. 3. The Indian Code of Criminal Procedure lays down strict rules to be followed by law enforcement agencies during arrests, detentions and any use of force. The Supreme Court of India and the National Human Rights Commission of India play a crucial role in ensuring accountability.

  4. 4. The Government of India has also issued guidelines and standard operating procedures for police and security forces to ensure the lawful and proportionate use of force. Regular training programs are conducted to sensitize the law enforcement personnel on human rights standards.

  1. 5. India’s democratic polity, society and governance framework is firmly founded on the Rule of Law, and our Constitution recognises and protects the Right to Life as a fundamental right. We remain fully committed to protecting these rights through our independent legal and institutional mechanisms.
