 Mr. Vice-President,

1. Indian delegation commends the role of Human Rights Council bodies and mechanisms in assisting the member States in the promotion and protection of human rights.

2. We are committed to constructively engaging with Special Procedures Mandate Holders (SPMH) and sharing relevant information with them regarding promotion and protection of human rights of our people, as pertains to their mandate. We reiterate our view that the trust and cooperation between member States and SPMH is a crucial element to ensure the effectiveness and success of SPMH in improving human rights situations. To engender trust and cooperation, it is of utmost importance for SPMH to exercise their respective mandates responsibly with objectivity, neutrality, transparency, independence and impartiality, in compliance with the Code of Conduct, as stipulated in Resolution 5/2.

3. However, we have noticed certain disturbing tendencies in the conduct of the SPMH that raise serious questions about their commitment to comply with the Code of Conduct, and working methods of Special Procedures. The tendency to make presumptive conclusions based on isolated instances and dubious logic should be avoided, including in the context of press releases and joint statements. In our view, such actions lead to erosion of trust in the institution of SPMH, and undermines their credibility and effectiveness.

4. The SPMH should take in to account the perspectives of and the information provided by member States and ensure that their statements and press releases are based on verified information as emphasized in Articles 6 and 8 of the Code of Conduct giving due recognition of the challenges faced by the member States. They should not let their personal prejudices and biases cloud their vision and perception and misuse their position.

5. In accordance with resolution 5/1, the selection and appointment of the mandate holders should be based on equitable geographic representation along with an appropriate representation of different legal systems.

6. Indian delegation takes note with appreciation the Recommendations made by the Forum on Minority Issues; and the Social Forum.

7. In conclusion, we reaffirm our commitment to continue promoting constructive dialogue and cooperation within the Council and with its different bodies and mechanisms.
