Right of Reply by India under Agenda Item 3: Interactive dialogue with the Working Group on arbitrary detention at the 54th Session of Human Rights Council (11 September - 13 October 2023) delivered by Dr. P.R. Thulasidass, Under Secretary, Geneva, 18 September 2023

 Mr. Vice-President,

1.  India is exercising the right of reply in response to the statement delivered by OIC’s Independent Permanent Human Rights Commission in the Interactive Dialogue with the Working Group on Arbitrary Detention earlier this afternoon.

2.  We strongly reject the factually incorrect, unwarranted and blatantly partisan allegations made by the Commission in reference to the Union Territory of Jammu and Kashmir of India that peddle false and malicious narratives against India.

3.  The detentions under Indian laws are carried out in accordance with the relevant provisions under our Constitution. There are no arbitrary detentions. Indian laws provide all necessary safeguards to detainees, including judicial review.

4.  The Commission has no locus standi to comment about the Union Territory of Jammu and Kashmir which is an integral and inalienable part of India.

I thank you, Mr. Vice-President.
