Mr. President,

We reject the references to India in the Special Rapporteur’s report. There is no situation of conflict in India that merits attention in the context of this report. The allegations therein are irresponsible and factually incorrect. The report is in complete disregard of the information that we have been providing to the mandate holder. As a result, it reflects a lack of understanding of the secular Indian polity, pluralism and democratic processes.

Mr. President,

We firmly believe that it is the responsibility of all sovereign States to ensure promotion and protection of rights of their minorities.

The Constitution of India guarantees justiciable fundamental rights to all Indian citizens without any discrimination on the basis of religion, race, caste, sex or place of birth. Right to equality, freedom of religion, cultural and educational rights and protection for linguistic minorities are notable provisions therein with specific relevance for minority communities. The right to Constitutional remedies allows the aggrieved to approach the Apex Court directly. In addition, there are various penal laws that provide for punishment for discriminating against or victimisation of minorities.

Our fully functional institutions such as the National Commission for Minorities, the National Commission for Minority Educational Institutions, the National Human Rights Commission and State Human Rights Commissions ensure protection of the human rights of our minorities and promotion of their welfare.

India remains committed to guarantee all rights to its minorities in line with its commitments under national and international instruments.
