General Comments by India on Consideration of the Resolution on “The Right to Development” at the 48th Session of the Human Rights Council (13 September – 08 October 2021) delivered by Mr. Pawankumar Badhe, First Secretary, Permanent Mission of India

Madam President,

  The Right to Development has been recognised as a distinct, universal, inalienable and fundamental human right that is applicable to all people in all countries, essential to realise the goal of inclusive and sustainable development as enshrined in 2030 Agenda.

2. At national level, States have the primary responsibility and obligation of adopting policies, setting priorities and allocating resources for realisation of the Right to Development. In our view transparent, accountable and participatory governance provide the conducive environment for realisation of the right to development. India is committed to realise the right to development, in the best interests of the people.

3. Equally important for realisation of the Right to Development are equitable and a conducive global economic order and cooperation, at the international level.

4. The draft resolution under consideration incorporates the responsibilities of States towards realization of the Right to Development as an integral part of all human rights and fundamental freedoms as well as the socio-economic development of their people. At the same time, it also calls upon all States and other international Organizations to strive for greater acceptance, operationalisation and realisation of the right to development.

5. The draft resolution supports the ongoing dialogue and engagement with all relevant stakeholders for further deliberations on this subject including integration of the Right to Development in international cooperation and further discussion on the draft legally binding instrument on the Right to Development. India always favours a global discourse on human rights, based on inclusive and constructive approach. In this spirit, India would continue to engage in dialogue and cooperation so as to realize the Right to Development for all.
