Mr. Chair,

1.India, on behalf on the Like-minded Group of Countries, has the honour to share our views on the theme under discussion.

2. Vide resolution 60/251 of the General Assembly, the Human Rights Council is expected, inter-alia, to contribute towards the prevention of human rights violations and respond promptly to human rights emergencies. While we are discussing issues related to prevention, it is essential to have constructive dialogue and cooperation between the States and the Council, thereby, enhancing trust building among all States. This contributes to promotion and protection of human rights which is primary mandate of the Human Rights Council.

3. All human rights bodies and mechanisms have specific tasks as mandated by the Council. The Council has certain guidelines established by resolution 60/251 to carry out its mandate. The Council, thus, shall be guided by the principles of universality, impartiality, objectivity and non-selectivity, constructive international dialogue and cooperation. It shall be responsible for promoting universal respect for the protection of all human rights and fundamental freedoms for all, without distinction of any kind and in a fair and equal manner.

4. In view of above, the Like-minded Group of Countries would expect that the role of the Council would be strictly in accordance to Article 5(f) of the resolution 60/251 that recognizes dialogue and cooperation as the way forward for issues related to prevention. Similarly, all the human rights bodies and mechanisms of the Council need to be guided by this principle. In addition, the functions of the Council including the issues related to prevention cannot undermine key UN principles such as acknowledging the primacy of States in promotion and protection of human rights, respect for national sovereignty, territorial integrity, non-interference in the internal affairs of States, non-selective and transparent approach.

5. In conclusion, the Like-minded Group of Countries hopes that the objective of this panel discussion would be on exploring various ways of engaging relevant stakeholders, modality of an inclusive and constructive approach as well as developing dialogue, consultation and cooperation with relevant stakeholders by the Council.
