Statement by India on Agenda Item 6 on Trademarks at the Thirty-ninth Session of the Standing Committee on the Law of Trademarks, Industrial Designs and Geographical Indications (SCT) [April 23 to April 26, 2018] delivered by Sh.    The Delegation of India thanks the WIPO Secretariat for the update on Trademark-Related aspects of the Domain Name System (DNS).

2. The Domain Name System raises a number of challenges for the protection of intellectual property. The registration of a domain name may be in conflict with trademark. As per the Indian system, the use of a domain name which is substantially similar to a registered trademark may be an infringement of the trademark.

We believe that the update provided by the Secretariat provides useful insights of the activities of WIPO in respect of the application of the UDRP (Uniform Domain Name Dispute Resolution Policy) and its possible extension to new forms of domain names assigned by ICANN, however, the update does not explain the extent to which the UDRP has been utilized by trademark owners from developing countries.
