Statement by India on Agenda Item 5 at the Thirty-ninth Session of the Standing Committee on the Law of Trademarks, Industrial Designs and Geographical Indications (SCT) [April 23 to April 26, 2018] delivered by Sh. Animesh Choudhury, Second Secretary on 23rd April 2018 in WIPO HQ, Geneva.

Mr. Chair,

First of all, the Delegation of India would like to congratulate the Delegation of France for their presentation on “Convergence Programme 6: Graphical Representation of Designs.

2.   While the Delegation of India would continue to constructively participate in the discussions on subject of Graphical User Interface(GUI), we would like to make some remarks on the subject.

Mr. Chair,

3.   We believe that the matter of protection of Graphical User Interface (GUI), Icon and Typeface/ Type Font Designs is a policy issue of individual countries.

4.   There are many member countries having a system of substantive examination, including India. For such countries, the issue would be adopting a uniform examination and search criteria and protection regime vis a vis parameters of.

5.   In case of multiple layer of protection under various IPRs, the interfaces between different IPR laws, for example Copyright and Industrial Design, need to be delineated.

6.  India believes that given the specific nature of Graphical User Interface (GUI), Icon and Typeface/Type Font Designs, it is still debatable whether the subject should be protected through Industrial Design regulation.
