Statement by India at the Universal Periodic Review (UPR) Working Group 27th Session (1-12 May 2017) on Rights of Lesbian, Gay and Bisexual Persons : 3rd UPR of India. [Geneva, 4 May 2017]

On the issue of rights of Lesbians, Gays and Bisexual Persons, Section 377 of the Indian Penal Code which criminalizes such acts by adults of the same sex in private, was in fact set aside and decriminalised by a High Court judgement which was however overturned by the Supreme Court. However, in an unprecedented move, the Supreme Court has itself agreed to re-examine the issue by referring a curative petition to a larger bench. The hearing is expected in the near future.
