Statement by India on Agenda Item 7, under Institutional Section (INS) on  “Complaint concerning non-observance by Fiji of the Freedom of Association and Protection of the Right to Organize Convention, 1948 (No. 87), made by delegates to the 102nd Session (2013)  of the ILC under Article 26 of the ILO Constitution

 

1. We thank the delegation of Fiji for their comprehensive presentation relating to latest developments in Fiji on labour issues.

 

2. India appreciates that the Government of Fiji invited ILO’s Direct Contacts Mission after agreeing to broader original terms of reference. We noted that the Direct Contacts Mission conducted their work in Fiji in October 2014 and their report was made available to Member States at the last GB Session.  My delegation appreciates that the Government of Fiji has taken the recommendations of the Direct Contacts Mission in the right spirit and have initiated a number of reforms for the betterment of workers’ rights.

 

3. My delegation also appreciates the commitment of the Government of Fiji to review all labour laws and practices to improve compliance with International Labour Standards.  The Memorandum of Understanding prepared by the Government of FIJI which is planned to be executed by the tripartite partners seems to be a positive step.  My delegation noes that the Government of Fiji has established a committee to review the Essential National Industries (Employment Decree 2011, which will be enacted as   Law by taking into account amendments from all stakeholders.  We understand that the amendments are also being drafted to the Workmen’s Compensation Act 1978.  My delegations considers these measures by the Government of Fiji to be a clear demonstration of their will to protect labour rights.

 

4. In view of the measures being taken by Fiji with regard to labour reforms and the tripartite agreement signed today, my delegation would like to urge the Governing Body and the Member States to consider deferment of decision to consider establishment of Commission of Inquiry with regard to the complaint concerning Non-Observance by Fiji of the Freedom of Association and Protection of the Right to Organize Convention 1948 till November 2015 Governing Body meeting.  At the same time, my delegation would also like to suggest that ILO may continue to undertake    the follow up work to ensure implementation of the recommendations of the Direct Contacts Mission and the Government of Fiji may be assisted with regard to training, capacity building and technical assistance.
